The EPA violation notice issued to ADS in September 2016 has been resolved. On September 29, 2019 a Consent Agreement and Final Order between the EPA and Advanced Disposal Services (CAFO) was finalize. (Consent Agreement and Final Order) The Township has continually requested that both the EPA and EGLE include in their enforcement actions a requirement for air quality monitoring at Ridgewood Elementary School to address one of the primary concerns of our residents. The good news - this Order includes a requirement for the installation of a hydrogen sulfide monitor at or near Ridgewood Elementary School for 5 years. It also requires the installation of 30 new gas wells, a civil penalty of $50,000, etc. Unfortunately, the Order did not specify time deadlines for the completion of any of the required actions. Township Supervisor Robert Nix contacted Nathan Frank, Chief, Air Enforcement and Compliance Assurance Section, and requested that time deadlines be obtained. Mr. Frank has confirmed that EPA has a commitment from ADS to complete all work by September 26, 2020. Mr. Frank also stated that ADS has commenced some of the actions and he expects that everything will be completed before the deadline.
